Maryland: Lawmaker Pushes Bill To Reverse Ban Of Contraceptives In Vending Machines At K-12 Schools

Maryland delegations have advanced a bill that reverses state laws that prohibit condoms and birth control in Maryland public school vending machines.

Representative Nicole Williams (D-MD). House Building 380 (HB380)seeks to eliminate a decades-old ban on the sale of birth control vending machines at K-12 public schools funded by state taxpayers.

Current penalties for breaching the law include a $1,000 fine.

“The bill prohibits misdemeanors for selling or selling contraceptives or contraceptive devices by vending machines or other automated devices at kindergartens, nursery schools, elementary schools or middle schools. and repeals the related penalties.” The bill can be found on the Maryland Legislature's website.

After the bill was introduced, deputy Kathy Siriga (R-Md.) responded, declaring that her state lawmakers “lost their heart” and warned their parents to “wake up.” .

The bill passed the house from 89 to 41 and has now moved to the Senate for consideration.

Despite various states reversing similar laws, Maryland remains one of the few states that sell birth control pills through school vending machines.

However, the law did not necessarily prevent students from accessing condoms, as school nurses, clinics, and external organizations usually provide birth control in many cases. However, it explicitly prevented the school from installing vending machines as a distribution option.
