McCormick sues over ‘illegal ballots’ — RNC chair calls out Dems for attempt to overturn PA election

Multiple local and national newspapers reported last week that Republican challenger and veteran Dave McCormick would win Pennsylvania's U.S. Senate race. Despite the writing on the wall, incumbent Democratic Sen. Bob Casey is not admitting defeat. Mr. Casey's supporters are now engaging in exactly that, repeating the same kind of language that Democrats have spent years condemning.

A few days after the Wall Street Journal Editorial Board
claimed Republican National Committee Chairman Michael Whatley said Democratic election lawyer Marc Elias is “coming back and trying to steal Bob Casey's Senate seat.” warned Democratic officials and lawyers are “trying to sow doubts about the democratic process,” he said.

That doubt is sure to grow even more as states conduct recounts and Democrats count illegal votes.

Federal Secretary Al Schmidt
announced Unofficial results announced Wednesday, with Philadelphia's legal and uncontested vote be consideredautomatically triggered a statewide recount under Pennsylvania law. Mr. McCormick reportedly leads Mr. Casey by a margin of 29,338 votes (48.93% to 48.50%). To avoid a recount, the next Republican senator must lead his opponent by 0.5%.

Schmidt suggested that after completing the initial count, counties must begin a recount no later than Nov. 20 and report their results to the Secretary of State by Nov. 27. The cost to taxpayers to confirm Mr. Casey's loss would be more than $1. Million.

Elizabeth, Communications Director at McCormick
noticed“Senator-elect McCormick's lead is irreversible, the Associated Press has made clear. Recounts are a waste of time and taxpayers, but that's Casey's prerogative. McCormick talks about what it's like to lose an election “I know and am confident that eventually Sen. Casey will lose.'' I come to the correct conclusion. ”

McCormick campaign consultant Mark Harris, who has repeatedly emphasized that there is no path left for Casey to win, said:
tweeted“Since 2000, there hasn't been a U.S. Senate race where the lead has changed hands by more than 500 votes. Again, I'm a broken record, but Casey has no choice but to waste over $1 million in taxpayer money.” [money.]”

“Please stop counting illegal ballots.”

“A small number of votes have changed due to recounts,” said Deb Ortiz, FairVote's director of research and policy.
said The Associated Press reported last month. “There will be a recount in 2024, but the results will remain the same.”

The Wall Street Journal Editorial Board said on Sunday that the recount had left Marc Elias with “legal consequences, from challenging Mr. McCormick's vote to searching for previously undiscovered ballots for Mr. Casey.” He suggested that there could be a chance to try out some cool pranks.

“Elias helped unseat Al Franken's Senate seat in Minnesota in 2008 by finding a judge who would count previously rejected ballots and overturn Republican Norm Coleman's lead. ”, the paper continued. “Elias' method is to find friendly judges who will rule in his favor. Pennsylvania has a Republican secretary of state who oversees elections, but there is a particularly partisan Democratic Party. A majority of the state Supreme Court. So far, Gov. Josh Shapiro and other officials have not commented on Mr. Elias.”

Whatley
swore The RNC and the Pennsylvania Republican Party “will have lawyers and monitors in every county in the state to ensure that only legal ballots are counted. Again,” he said.

According to The RNC filed two new lawsuits against Whatley on Wednesday night in Bucks County and the Pennsylvania Supreme Court, seeking to “stop the counting of illegal ballots.”

Whatley
clarified “Bucks County is again violating Pennsylvania law by choosing to count undated and misdated ballots, this time in a race already won by Dave McCormick,” Bucks County said in a statement.

of
lawsuit In a lawsuit filed by Sen.-elect McCormick and the RNC against Bucks County, the board's decision states that “undated or misdated mail-in ballots are not legally valid,'' as the Pennsylvania Supreme Court ruled. “This is legally incorrect because it cannot be counted in the 2024 general election.” It's already clear. ”

LevittownNow.com reported The Democratic-controlled Bucks County Board of Elections announced it had approved most of the approximately 4,500 provisional ballots it received to be examined and counted.

The Pennsylvania Supreme Court has dominated And he reiterated that county election officials cannot count absentee ballots with incorrect or missing dates. State law requires mail-in ballots to be returned in two envelopes. The inner and outer envelopes must be signed and current dated by the voter.

“The Board’s incomprehensible decision not to enforce date requirements and count noncompliant ballots is in direct violation of binding Pennsylvania law,” the complaint continues.

The lawsuit further alleges that the county commission's decision violates the Equal Protection Clause of the U.S. Constitution and the Pennsylvania Constitution.
