Washington’s New Approach to Student Loan Debt Collection

Education Secretary Linda McMahon has announced plans to reach out to the 43 million Americans with student loan debt, noting that the Treasury Department will now oversee debt collection. It’s estimated that around 9 million of those borrowers are currently in default.

The letter explains that this change aims to enhance efficiency in the collection process, especially after loan repayments were paused for much of the Biden administration. This suspension currently protects borrowers from delinquency until September 2024.

“For too long, Americans have faced the repercussions of poor management within the federal student aid system. Today’s move is about restoring integrity and accountability,” McMahon wrote, sharing this sentiment in advance of the letter’s widespread distribution.

At present, there’s a staggering $1.7 trillion in student debt, with last year’s estimates suggesting that about 25%—or roughly $425 billion—was in default.

This transition assigns new duties to Treasury Secretary Scott Bessent, placing the fiscal bureau in charge of the collections.

McMahon mentioned that the Department of Education has struggled significantly in managing the collection of debts owed to taxpayers.

She pointed out, “The previous administration left borrowers confused about their repayment obligations and without adequate support.” She emphasized the urgency of the situation, stating that it’s detrimental to students and harmful to the nation’s finances, advocating for an organization with extensive financial expertise to take over this responsibility.

While the FAFSA will remain unchanged for those seeking financial aid, borrowers currently making repayments are expected to continue doing so through their existing loan servicers.

The Treasury Department will handle the collection of overdue student loan debts and offer assistance to borrowers in repayment.

Notably, the IRS, which is part of the Treasury, has the authority to garnish up to 15% of wages from delinquent individuals.

Student loan borrowers can establish repayment limits based on their income, which can be as low as 10% of discretionary earnings.

Bessent noted that “Under President Trump’s direction, we are making a serious effort to address the mismanagement within a $1.7 trillion portfolio that has suffered for years.” He pointed out that the Treasury Department possesses the unique capabilities and expertise to instill proper financial discipline in student loan programs.

McMahon, aligning with President Trump’s ambitions to eventually dismantle her department, criticized universities for inflating tuition using federally guaranteed loans. “As colleges increase tuition rates, viewing these loans as endless funds from taxpayers, many Americans find themselves burdened by overwhelming student debt,” she wrote, adding that a significant portion of students in various degree programs are often worse off financially because of their educational choices.
