The attorneys representing convicted murderers Eric and Lyle Menendez have taken action to disqualify Los Angeles County District Attorney Nathan Hochman and his office from representing the nation in their brother Restin Case.
Attorney Mark Jelagos and his Coconsell filed a document on Friday with the announcement of a motion disqualifying Hochman’s office, citing a “conflict of interest.” The claim comes before Los Angeles County Superior Court Judge Michael Jessick.
The brothers, who live without parole after killing their parents in 1989, are fighting for the diminished sentences.

The next scheduled hearing date for the incident is May 9th.
“The allegations come under the constitutions of the United States and California, and California Criminal Code 1424, on the ground that without rebuttal, the defendant is likely to receive a fair hearing or fair treatment through all relevant procedures.”

If the claim is not granted, Geragos demands a hearing of evidence, demanding that the court be shown that there is a conflict of interest, and plans Hochmann and several other testimony.

The move focuses on lawyers Hochman has recently been hired to work in the district attorney’s office.
Last October, Los Angeles County District Attorney George Gascon announced that he was considering a request for responsiveness for the Menendez brothers.
Shortly afterwards, more than 20 Menendez families in support of the res met with Nancy the Berge and Associate District Attorney Brock Lansford.
Milton Andersen, a single family member who did not object to the meeting, filed Amicas briefs through his lawyer, Kathleen Keddy, opposed restinsing.

After Hochman defeated Gascon on November 5th last year, Hochman began reopening his office with those who opposed the Menendez brothers’ responsiveness, according to documents filed by his brother’s lawyers.
Jelagos said Hochman intentionally reassigned Lansford, who was deliberately considered a Menendez sympathizer, to another office. He also said Hochman hired Cady and on behalf of only Menendez family members against responsibilities, he led the service of the victims of the District Attorney’s Office despite his recognition of the conflict of interest that Cady had in the case.

The document said Caddy’s conflict of interest was also spreading outside the courtroom.
She is a board member of the group called Justice for murdered children, according to Jelagos, and on April 13 the group held a rally found by Hochman. During the meeting, the group condemned the Menendez brothers’ resentment.

The document also alleged that Cady ignored Menendez’s family with his official capabilities at the victim’s service office and failed to warn him of the horrifying imagery from the murder scene being displayed at the April 11 res suit hearing.
Menendez Brothers’ aunt was hospitalized after DA shared a graphic photo in court: “There was no warning.”

In 1994, their first trial ended with fraud. They were convicted after their second trial in 1996. They spent 35 years at the bar.
