Michael Cohen Loses Appeal To Revive Retaliation Claim Against Trump

Michael Cohen, President Trump's former lawyer, has lost his appeal to reinstate his claim that the former president retaliated against him for promoting a tell-all book that criticized him.

A disagreement over whether he could talk to the media about his upcoming book while under house arrest ultimately led to his return to prison, according to a lawsuit filed by the American Civil Liberties Union (ACLU).

Cohen complained of experiencing physical ailments, including headaches, shortness of breath and anxiety, while spending most of the day in a small cell at a federal prison in temperatures “over 100 degrees.”

Then, in July 2020, a federal judge ruled that Cohen could be placed under house arrest instead.

When Cohen's book Disloyal: A Memoir was first published, it peaked at number one on the Amazon bestseller list.

Mr. Cohen tried to recover the retaliation charges against Mr. Trump, but the charges were again dismissed by U.S. District Judge Louis J. Lehman, a lawyer previously appointed by Mr. Trump.

In his latest firing, Mr. Lehman reiterated that Mr. Cohen lacked a sufficient basis to allege that federal employees violated the Constitution on their behalf.

President Trump's lawyer, Aina Haba, praised the court's decision.

“We are very pleased with today's ruling. Mr. Cohen's case was doomed from the beginning. We will continue to fight against any frivolous lawsuits aimed at our client,” Haba said. said.
