Minnesota Senator Set to Resign After Felony Conviction

A Minnesota state senator is expected to step down following her felony conviction for robbery linked to an incident in 2024. Senator Nicole Mitchell, 51, plans to resign by early August 4.

She represents District 47, which is in the suburbs east of Saint Paul. Mitchell is a member of the Democratic-Farmer-Labor Party (DFL) and was also convicted on a second felony charge for possessing a tool intended for robbery.

Mitchell was arrested on April 22, 2024, after allegedly breaking into her stepmother’s home to recover her father’s ashes and personal belongings following his death. Bodycam footage captured her during the arrest, where she stated, “I’m trying to get some of my dad’s.” Acknowledging her situation, she added, “Obviously I’m not good at this.”

During the trial, Mitchell admitted to trespassing but insisted she was there to check on her stepmother, who suffers from Alzheimer’s, not to steal anything.

DFL Senate Majority Leader Erin Murphy has called for Mitchell’s resignation, emphasizing the need for accountability, especially in light of the conviction. She noted the resolution of Mitchell’s trial brings clarity and allows the caucus to refocus on pressing issues for Minnesotans.

Republican Senate leader Mark Johnson argues for Mitchell to vacate her position immediately rather than waiting until August. He expressed concerns that her continued presence in office is more about the DFL needing her vote than ethical accountability.

As of now, Mitchell has not responded to requests for comment regarding her situation.
