Missouri AG filing lawsuit against Biden administration for allegedly flying illegal immigrants to state

Missouri Attorney General Andrew Bailey is suing the Biden administration over its alleged use of planeloads of illegal immigrants into Missouri.

Bailey told Fox News Digital that he will file a lawsuit against President Biden and Vice President Kamala Harris for refusing to provide paperwork for illegal immigrants to fly into Missouri.

“I have reason to believe they are knowingly sending illegal immigrants across the border into our cities, and not on my watch,” Bailey said in the X post.

In the complaint, disclosed exclusively to Fox News Digital, Bailey alleges that the Department of Homeland Security (DHS) intentionally delayed responding to his request for documents related to his Missouri-bound flight.

“This game of ‘hide and seek’ violates both the spirit and the letter of the Freedom of Information Act, which provides that agencies should withhold information only if ‘disclosure could reasonably be foreseen to prejudice an interest protected by an exemption’ or ‘disclosure is prohibited by law,'” the complaint states.

“The Department of Homeland Security’s concealment of critical information has prevented the public from exercising the rights Congress provided in the Freedom of Information Act. This lack of transparency and refusal to comply with lawful Freedom of Information Act requests impedes efforts by the Missouri Attorney General’s Office to determine the size and scope of illegal immigration in the Show Me State,” the lawsuit continues.

Bailey said the deportation of illegal immigrants into Missouri is a matter of public concern and Missourians have a right to know the facts about these alleged activities.

The lawsuit also alleges that the Department of Homeland Security never notified them that “extraordinary circumstances” might delay its response or the production of documents.

Bailey added that DHS has not produced any of the requested records, nor has it demonstrated that the requested records are exempt from production. DHS has also not indicated when it will produce the requested records, Bailey said.

“Once again, the Biden administration is attempting to obstruct and circumvent every aspect of the law to hide information from the American people,” Bailey argued. “Their recent refusal to reveal the truth about the influx of illegal immigrants into Missouri is just the tip of the iceberg.”

Bailey said this lack of action reflects a broader pattern of deploying delay and diversion tactics to avoid producing documents lawfully requested under FOIA.

“Here in Missouri, we will hold bad actors accountable who don’t follow the law, even if it’s federal, and I won’t stop until we get answers for Missourians,” Bailey said.

In June, Missouri joined a coalition of 18 states in filing a lawsuit. Opposed to the Biden administration The new “diversion of legal pathways” proposal would “allow a huge number of foreigners to enter the country and receive immediate work authorization and faster access to public benefits,” it said.

“The situation at the southern border is out of control, and it’s all Joe Biden’s fault,” Bailey previously said.. “He has refused to discharge his constitutional responsibilities and we will be taking him to court to compel him to do his job.”
