NC changes same-day voter registration rules, former process ruled unconstitutional

North Carolina election officials will tweak how the state handles same-day voter registration as Republican lawmakers push to make it easier to throw away ballots and critics say it’s too difficult for voters to access polling places. It is said that

On Tuesday, attorneys for state election officials announced revised rules to verify the addresses of people who register to vote and vote the same day. The change was made after a court ruled that if even one piece of mail sent by the Election Commission is returned as undeliverable, there must be a formal way to appeal to be removed from the voter rolls. .

The State Board of Elections has sent an updated memorandum to county elections offices and filed in federal court on how to implement same-day registration. North Carolina offers the option to register to vote and vote instantly during the 17 days before a primary or general election.

The state’s primary election is March 5th, and the early voting period, which includes same-day registration, begins February 15th.

In October, the Republican-led General Assembly passed sweeping voting legislation that, in part, would allow same-day ballots to be counted if even one notice mailed to a registrant’s address is returned as undeliverable. The authorities have been ordered to remove it from the list. Previous law required him to send two pieces of mail to the county and invalidate the ballot if both pieces were returned as undeliverable. Rulings in previous cases have discouraged local election boards from challenging such votes before the final count.

Democrats and voter advocacy groups filed a lawsuit seeking to block the 2023 bill after the Legislature overrode a veto from Democratic Gov. Roy Cooper.

U.S. District Judge Thomas Schroeder ruled last week that it was likely unconstitutional to throw away ballots without warning them about the problem or giving them a second chance to verify their address. Schroeder cited the possibility of U.S. Postal Service delays or data entry errors by election officials that could result in registrants being mistakenly disenfranchised.

Schroeder wrote in a Jan. 21 letter that the preliminary injunction will remain in effect until due process concerns are resolved. It was not immediately clear Tuesday whether the updated rules would satisfy the judges.

In North Carolina, more than 100,000 new registrants sought same-day registration in each of the past two presidential general elections, and approximately 2,150 new same-day registration applicants failed to verify their address in the November 2020 election. . Small adjustments to the same-day rules could affect elections for president, governor and other statewide offices this fall, which have been extremely close in recent election cycles.

The latest guidance from state Elections Director Karen Brinson Bell, dated Monday, lays out how counties should handle same-day registration. This applies if the address verification card is returned as undeliverable within two days before the county’s final vote count.

Election officials first need to check whether the address on the card and the registration application match. Otherwise, applicants must be contacted by mail, email, or phone to provide new identification or the opportunity to appeal directly to the county election board on the final count date.
