New Hampshire Republicans Pass Mandatory Sentencing for Fentanyl Traffickers

New Hampshire Democrats are trying to block Republicans from cracking down on fentanyl traffickers, but one state senator says a “tough on crime” approach won’t work.

The N.H. Senate voted Thursday along party lines to: pass a bill Anyone convicted of bringing any amount of fentanyl into the state with intent to distribute faces a mandatory minimum sentence of five years in prison, WMUR reports.

“People are dying from this disease, and this state simply isn’t creating it,” said Sen. Daryl Abbas (R-Ky.). “It was brought here.”

Democrats unanimously voted no. SB316and argued that the war on drugs “didn’t work” when it was previously attempted.

“I grew up in the ’90s,” said Sen. Becky Whitley (D). “We remember being ‘tough on crime,’ but it hasn’t worked. We continue to have an opioid crisis.”

Two other bills were passed with bipartisan support that would add minimum requirements for those who cause a fatal fentanyl overdose or possess more than a certain amount of the drug.

SB414 If the person who distributed the fentanyl dies, a convicted fentanyl dealer would face a minimum sentence of 10 years in prison. SB415 It sets minimum standards for people convicted of possessing five ounces or more of drugs such as cocaine, methamphetamine, heroin and fentanyl.

Some Democrats remained opposed, saying the bill would not tolerate drug users themselves.

Sen. David Watters (D) said, “Judges are prohibited from even considering the fact that someone in this particular case may have been mentally incompetent due to drug use.” said. “That’s what’s being taken away here.”

Republican Majority Leader Sharon Carson is adamantly opposed to mandatory penalties for drug traffickers.

“We have had mandatory minimums, but we have moved away from mandatory minimums. I would like to ask you what has changed,” she said. “Have we seen drug possession go down? No, we haven’t.”
