New Legislation Prohibits Medicaid Coverage for Gender Transition Procedures

House Republicans Prohibit Taxpayer Funding for Gender-Transition Procedures

House Republicans have successfully inserted a provision into the “big, beautiful bill” that bans taxpayer money from being used for any gender-transition treatments.

During a markup session on Wednesday night, the House Rules Committee enhanced a clause from the Energy and Commerce Committee that initially restricted Medicaid, CHIP, and Affordable Care Act funding for gender transitions only for individuals under 18.

This markup removed references to “for minors” and “under 18” from the legislation.

The provision is rooted in Texas Rep. Dan Crenshaw’s Do No Harm in Medicaid Act.

Essentially, it modifies Section 1903(i) of the Social Security Act to block federal payments for what it refers to as medically unnecessary procedures related to gender transitions.

A poll by Cygnal in April 2025 revealed that 66% of Americans are against using taxpayer funds for gender transitions.

A senior legislative official mentioned to The Daily Signal that the original provision could save $1.4 billion, although the Congressional Budget Office assessed the savings to be approximately half that amount.

Early Thursday morning, the House of Representatives passed the budget reconciliation bill by a narrow 215-214 vote.

The bill is now headed to the Senate for consideration.

After the vote, House Speaker Mike Johnson stated he had urged Senate Republicans to keep modifications minimal, as this would facilitate its passage to the president’s desk by July 4.
