Trump’s Legal Victory in New York
President Donald Trump has achieved a significant legal win as the New York Court of Appeals has dismissed the $500 million fraudulent penalty he was facing.
On Thursday, the Appeals Division reversed its initial ruling of $464 million against Trump, related to allegations of artificially inflating his net worth—claims that the total has escalated to $515 million due to interest. This situation involved accusations that he misled banks to secure favorable loan and insurance agreements over a decade.
Despite the dismissal of this financial penalty, several cases brought by New York Attorney General Letitia James against Trump remain active and are set for review by the state’s Supreme Court. The president is pressing on.
While the significant financial fine was overturned, the court did affirm that Trump and his family businesses participated in fraudulent activities.
The 323-page decision included three different opinions, all agreeing that the severe fines imposed on Trump were “excessive.”
“While the court’s ordered relief aims to address the defendant’s business culture, the requirement for him to pay nearly $5 billion to New York is an excessive penalty that violates the eighth amendment of the US Constitution.”
Nonetheless, the panel of five judges upheld the prohibition on Trump and his two eldest sons, Donald Trump Jr. and Eric Trump. Additionally, a three-year mandate was established, requiring external monitors to oversee and report on the financial dealings of Trump’s organization.
To continue the enforcement of this ruling during the appeal, Trump had to post $175 million in bonds.
The case is now poised for immediate attention by the New York Court of Appeals, as the Thursday ruling did not reach a majority opinion.
James has repeatedly accused Trump and others of implementing “stunning scams” within his circle. Trump, however, insists he is the subject of a politically motivated attack led by the Attorney General.
In his characteristic style, Trump applauded the ruling through two posts on True Society, reiterating that the whole affair has been a “political witch hunt.”
“This is a complete victory regarding the fictitious case from New York’s state attorney general, Letitia James,” Trump remarked. “I appreciate that the courts had the courage to reverse this illegal and shameful decision that was detrimental to businesses throughout New York.”
Conversely, James issued a statement emphasizing that while her financial judgment was overturned, the court’s findings still affirm the liability of Trump, his company, and his two children for fraud.
“Today, the court confirmed its well-supported findings. Donald Trump, his company, and his two children are accountable for fraud.”
The Attorney General also mentioned that her office is pursuing legal action to reinstate the penalties.
Recently, the Department of Justice summoned James as part of an investigation into potential civil rights violations. John Salcone, a US attorney from the Upstate District of New York, followed up with two subpoenas directed to James. Some of these relate to her office’s civil fraud case against Trump, while sources also indicate that the second subpoena connects to an ongoing investigation involving the National Rifle Association.
