New York Court of Appeals Dismisses Donald Trump’s Request to Lift Gag Order

The New York State Supreme Court has rejected former President Donald Trump's request to deregulate his business records lawsuit.

New York Court of Appeals Fired President Trump is seeking to lift gag orders that restrict what prosecutors and their families can say in public.

Trump's lawyers argued that the gag order restricts Trump's First Amendment rights and that it is in the public's interest to lift it before the presidential election, and they asked Judge Juan Marchan to lift the order after the conviction.

But the court's ruling said “constitutional questions are not directly relevant” to dismissing Trump's appeal.

Despite Thursday's dismissal, Manhattan District Attorney Alvin Bragg's bid to convict Trump may be in jeopardy.

Judge Marchan recently postponed President Trump's sentencing until November 26, 2024, after Election Day. After a previous postponement, President Trump's sentencing was scheduled for September 18.

Trump asked Marchan to have his conviction overturned following a Supreme Court ruling in July that said the president enjoys executive immunity for acts committed in official capacity. That request led to the initial stay of the sentence.

The former president has also accused Marchan of financially benefiting from his prosecution. The House Judiciary Committee has issued a subpoena to Marchan's daughter, Lauren Marchan, seeking all documents related to her company's work for Democratic campaigns that raised funds in cases where Marchan presided over the case.
