Second Amendment activists scored another victory Thursday against New York state's expansive gun control regime.

A federal judge has ruled against a newly enacted state law that prohibits firearm owners from carrying concealed weapons on all private property unless the licensed owner authorizes the weapon with signed or explicit consent. said it violated the constitutional right to keep and bear arms.

“New York's restrictions are unconstitutional, at least when it comes to private property that is open to the public (the subject of this motion),” said U.S. District Judge John Sinatra Jr., a Trump appointee.

Citing recent Supreme Court precedent, the justices said, “Regulation in this area may only occur if the government demonstrates that the new statute is consistent with the nation's historical tradition of sufficiently similar regulations.'' It is permissible.” “New York fails that test here.”

The judge also denied New York's request for a two-week stay on the ruling, saying it was unlikely the state would prevail on the merits while the state attorney general's office appeals.

Sinatra said property owners have the right to exclude legal gun owners from bringing firearms onto their property. “but state cannot exercise that right unilaterally, thereby interfering with the long-established Second Amendment right of law-abiding citizens to act in self-defense on private property open to the public. . ”

The Concealed Carry Improvement Act, signed by Democratic Gov. Kathy Hochul in July 2022, follows a Supreme Court ruling that declared the state's previous concealed carry permit requirements unconstitutional. Last December, the U.S. Court of Appeals for the Second Circuit blocked several provisions of the law from taking effect, but allowed concealed carry permit applicants to demonstrate good moral character and include household members and family members on their permit applications. The controversial requirement to disclose members was upheld.

The appeals court also upheld the ban on concealed carry in so-called “sensitive areas,” including theaters, bars, parks and other spaces.

Gun rights activists praised Sinatra's decision. “This is another important victory for Second Amendment rights, and a major victory for New York, authoritarian governments, and radical anti-rights groups like Everytown and Giffords,” said Brandon Combs, president of the Firearms Policy Coalition. This is another huge loss for the organization.”

“We continue to move forward to restore the full scope of the right to keep and bear arms across America. Hopefully, Kathy Hochul is ready to write another check for legal costs.” he added.

The New York Attorney General's Office did not respond to a request for comment.

Earlier this week, Hochul praised his administration's gun control policies and announced that gun violence in New York state has decreased by 47% since taking office in 2021.

“And you all know what happened when the Supreme Court overturned the concealed carry law and stripped the governor of his authority to ensure the safety of his citizens. We did not raise our hands when we surrendered.'' And we surrendered. We fought back,” Hochul said.

“We came together, we passed a law, and we ban the carrying of concealed weapons in sensitive areas. I personally think all places are sensitive, right? Well, we drew the line, okay? We decided, 'What was sensitive, and so far we're doing well. ”

But gun rights groups argue that Sinatra's decision shows Hochul is wrong.

“As we have said all along, the 'sensitive area' restrictions imposed by New York City after Bruen are unconstitutional and must be stopped,” said Bill Sack, Legal Director of the Second Amendment Foundation. . “We are thrilled that the court once again agreed and sent this unethical and illegal ban.”
