Fox News contributor on Comey indictment: 'I don't think there's a case'

On Friday, legal commentator Andy McCarthy expressed doubts about the Trump administration’s ability to pursue a credible lawsuit against former FBI director James Comey.

“I don’t think there’s a case,” McCarthy mentioned during his appearance on Fox Business’s “Morning with Maria.”

Analysts at Fox have noted that much of the Trump administration’s assertions seemed more speculative than fact-based, particularly regarding the allegations surrounding Russia.

“McCarthy pointed out that Comey allegedly prompted a leak to the Wall Street Journal,” he elaborated.

“When you examine what McCabe stated, he indicated that he directed the Wall Street Journal to leak information and informed Comey afterward,” he told host Maria Bartilomo.

“Essentially, Comey didn’t permit it in the sense that he controlled it before it happened,” he added. “I’m uncertain how they can justify that assertion.”

Others have also raised questions about the accusations against Comey.

Senator Tim Kaine (D-Va.) suggested that Attorney General Pam Bondy was pursuing action against Comey largely to satisfy the president.

“If she believed there was strong evidence to indict Jim Comey, she wouldn’t have concluded her official statement with, ‘we will follow the facts in this case,'” Kaine stated, referencing Bondi’s remarks regarding Comey’s indictment.

“That’s part of the investigative process—deciding whether to indict a person or not. They didn’t indict anyone, and yet said, ‘The facts will guide us,'” he continued.

Kaine noted that Bondy’s comments hinted at a “deep ambiguity” regarding Trump “ordering” her actions.

Previously, McCarthy had criticized Bondy for displaying partisanship by establishing a “weaponization working group” within the Department of Justice.

“It’s important to note: Pam Bondy represents the Department of Justice, and she has an ethical obligation to support the defense of individuals in governmental matters,” McCarthy remarked earlier this year.

“If she’s attempting to echo Trump’s grievances without framing the actions of the Justice Department appropriately, then she’s engaging in politically motivated law enforcement.”

Nevertheless, both Trump and FBI Director Kash Patel have rejected suggestions that they are misusing their authority against political adversaries.

“FBI agents and intelligence staff are steering the investigation into figures like Comey and others. They maintain their responsibilities,” Patel stated on the social platform X.

Trump later echoed similar sentiments, broadly alleging that Democrats faced investigations and legal actions from the department due to “corruption.”

“These were corrupt, radical left Democrats,” Trump remarked outside the White House.

“They weaponized the Department of Justice, which is unprecedented. What they’ve done is appalling, and I hope for accountability. I hope there are others involved.”
