NJ congresswoman appears in court Tuesday regarding intense conflict at ICE facility.

The New Jersey lawmaker, who was part of a widely reported incident outside an immigration facility last month, is set to appear in court today. The charges involve allegedly obstructing a federal officer, specifically a Homeland Security agent.

Rep. Lamonica McIver, a Democrat from New Jersey, is facing three charges related to her actions during the arrest of Newark Mayor Ras Baraka at Delaney Hall on May 9. She has stated her intention to plead not guilty.

McIver, along with two other Congressional colleagues, claimed they were visiting the area as part of Congressional oversight in response to protests about immigration policies when they encountered federal agents. What started as oversight turned tumultuous, with clashes erupting.

According to a press release from the Department of Justice, Baraka was allowed to enter a designated safe area at the facility, yet he was warned by federal agents to leave, which he didn’t do. During the attempted arrest of Baraka, McIver intervened, reportedly placing an arm around the mayor and confronting another officer who, she claimed, had pushed her.

If convicted, the initial two charges could lead to a maximum of eight years in prison each, while the third charge could result in up to a year.

The charges were initiated by Alina Haba, a U.S. attorney for the New Jersey area, who has previously represented former President Donald Trump. Haba accused McIver of attacking and obstructing law enforcement. Meanwhile, McIver has criticized the charges, suggesting they mirror past efforts by the Trump administration to suppress political dissent.

In a statement, she expressed confidence in her eventual exoneration, viewing the charges as politically motivated. She remarked, “This indictment is far less justified than the initial claims, reflecting a broader attempt at political intimidation.” McIver added that she appreciates the support she’s received from her community and looks forward to her day in court.

Baraka was arrested as well, allegedly trespassing at the facility. Concurrently, a liberal watchdog group, the Campaign for Accountability, filed an ethics complaint against Haba, accusing her of serious misconduct in relation to the prosecution of McIver and Baraka’s arrest. The complaint contends that their actions were retaliatory for their involvement in protests and oversight visits.
