Officials say New York US Border Patrol agents have forced the women to expose their breasts to enter the country.
Shane Milan, 53, of Jefferson County, New York, admitted that he ordered him to take the top off for him “for his own satisfaction.” US Lawyers' Office for the Upstate New York.
Border agents once refused to allow women to enter the United States with their infant child.
He also searched for phrases in Spanish, such as “I need to lift my shirt or bra,” according to the documents.
Milan's crime occurred while he was stationed on Wellesley Island, on the US-Canadian border. There, I was responsible for handling immigration via webcam when I moved from Mexico to the country.
Court records show that while dealing with the woman who was with her young daughter on August 10, 2023, Milan lied and told her that her files had tattoos on her chest.
When she responded by saying she had no such tattoo, Milan ordered her to lift her top and show him via webcam from the border intersection of Eagle Pass, Texas, according to his legal agreement.
During the same call, he told the woman he had to show his breasts again to make sure he had no tattoos, and when she refused, he told her he wouldn't sign her papers to enter the US if she had not done so, records show.
When the woman put the baby on the ground and exposed her breasts one more time, Milan told her, “OK… Welcome to the Usa.”
Milan ordered the second woman to expose her breasts after asking her husband and children to first leave the room on August 25, 2023, his judicial agreement said.
After she said she had a tattoo on her collarbone, the woman first pulled her shirt neckline to show him, and ordered Milan to lift her shirt and bra on two separate occasions during the interview.
Milan is accused of ordering other women to expose their breasts during virtual processing, court records said.
He also searched for phrases in Spanish, such as “I need to lift my shirt and bra” and “To make sure I need to lift my shirt.”
He pleaded guilty in federal court in Syracuse on Friday to deprivation of two counts of rights under the law's rights of color.
Milan is scheduled to be sentenced July 7th and faces a maximum sentence of two years in prison and a fine of up to $200,000.
