OpenAI Requests Investigation into Elon Musk’s Conduct

OpenAI, led by Sam Altman, has reached out to the attorneys general in California and Delaware to investigate what it claims are Elon Musk’s anticompetitive actions. This request coincides with the upcoming jury selection, set for April 27, in a significant trial involving Musk and Altman’s AI company in Northern California.

On Monday, OpenAI announced it had sent letters outlining allegations against Musk and his associates. Jason Kwon, OpenAI’s chief strategy officer, accused Musk of orchestrating efforts to undermine the organization, allegedly partnering with Meta CEO Mark Zuckerberg in these endeavors. The accusations suggest that Musk has been gathering research from competitors about Altman and disseminating it to potential investors and partners.

The tension between Musk and OpenAI is not new. Musk was a co-founder of the AI institute in 2015 alongside Altman and other leaders. Initially, the institute functioned as a nonprofit, but Musk departed in 2018 after unsuccessful attempts to merge it with Tesla.

Kwon warned that Musk’s actions could obstruct OpenAI’s goal to create artificial general intelligence (AGI), a form of AI capable of performing tasks at or above human intelligence across various domains.

Kwon’s letter expressed concern that these actions seek to shift control of AGI’s future from those committed to its safe and ethical development to competitors who may not prioritize these values. He stated, “These attacks are aimed at taking control of AGI’s future out of the hands of those who have a legal obligation to pursue its mission of ensuring that AGI benefits all humanity.”

This appeal to California and Delaware authorities is particularly interesting given Musk’s history with both states, where he has often claimed bias against him and his businesses. This tension prompted him to move Tesla and SpaceX from California to Texas and re-establish operations in Nevada and Texas.
