Over 85% of Migrants Arriving at Border Are Released into U.S.

More than 85% of migrants who arrive at the U.S.-Mexico border are released into the U.S. interior. “It is important to note that the Immigration and Nationality Act (INA) requires that illegal aliens entering the United States be removed from the moment they are encountered or detained until they are determined to have a legal basis to remain in the United States,” the report states.

Notably, the report found that only 36% of immigrants were detained by DHS for at least some time while their cases were being adjudicated in fiscal year 2021. Compare this to fiscal year 2013, under former President Barack Obama's administration, when 91% of immigrants were detained for at least some time while their cases were being adjudicated.

In an interview with the committee in September 2023, Yuma Sector Deputy Chief Constable Dustin Caudle said that since January 2021, about 65-70% of migrants encountered in the area have been released into the American community without being detained.

Earlier this year, Mayorkas acknowledged that more than 85% of migrants arriving at the border are being released into the interior of the United States.

Former San Diego Sector Chief Patrol Officer Aaron Heitke told the committee in May 2023 that senior Homeland Security officials regularly pressured the Border Patrol to “do everything in their power to keep our border agents safe.” [the number of illegal aliens in detention] under.”

The report criticizes Biden, Harris and Mayorkas for continuing to try to reduce Immigration and Customs Enforcement (ICE) detention space amid mass releases of migrants while “not using all of the beds Congress has made available.”

Big Bend Sector Chief Patrol Agent Sean McGoffin told the committee in April 2023 that “everyone” who arrives at the border “should be detained” because detention is “absolutely” important to immigration enforcement.

As the report states, the Department of Homeland Security’s own data shows that 82 percent of immigrants who are not continuously detained continue to live in the U.S. after several years, and that immigrants who are not deported within 12 months of arriving are “rarely” deported or not deported at all.

Meanwhile, if immigrants are detained, there is a 97 percent chance they will be deported.
