Concerns Over New York’s Voting Protections Ahead of Midterms

A recent warning from an election integrity watchdog highlights that one blue state has yet to implement adequate voting protections, as the November midterm elections approach.

The organization, Restoring Integrity and Trust in Elections (RITE), claims that the New York State Board of Elections (NYSBOE) has rejected a request to modify the state’s voter registration forms, a step that is seen as necessary for compliance with federal voting regulations.

In a letter delivered to the NYSBOE in late 2025, RITE outlined several violations they believe could jeopardize the integrity of elections in New York. Following the board’s inaction on these issues, RITE, along with Congresswoman Claudia Tenney, is now pressing the board to provide comprehensive records to uncover any further flaws in the state’s voter registration system.

“The lack of response is troubling and suggests a disregard for the public’s trust regarding the accuracy of voter rolls as mandated by federal law,” they stated in a letter to the NYSBOE, which was obtained recently by a news outlet.

RITE and Tenney are even considering legal action in federal court to compel compliance with federal regulations should the board miss a May 2026 deadline.

Allegations from RITE indicate that New York’s voter registration form has two significant errors that run afoul of the Help America Vote Act (HAVA). First, the state does not require applicants to provide driver’s license information when available. Moreover, it has continued to register individuals who haven’t given a driver’s license number, the last four digits of their Social Security number, or a declaration asserting that they possess neither, as federally required.

These mistakes, RITE argues, lead to millions of voters submitting incomplete registration information, complicating the state’s ability to accurately manage its voter lists.

A 2022 report indicated that about 3.1 million registered voters in New York were missing identification information on their registration forms, further raising concerns.

RITE and Tenney also criticized the board for not performing an audit to assess how many incomplete voter registration applications had been processed.

“The law is unmistakable: states cannot accept registration forms that lack required identifying information,” stated RITE President Justin Riemer. “This significant violation undermines the integrity of New York’s voter registration system.”

Riemer emphasized their commitment to uncovering the extent of the problem and assisting states in rectifying it.

As for Congresswoman Tenney, who chairs the Election Integrity Caucus, she’s been advocating for an investigation into the NYSBOE since 2022. “Clear and accurate voter rolls are critical for maintaining public confidence in elections,” she remarked. “The people of New York deserve accountability and full compliance with HAVA to ensure that every vote counts.”

The NYC Board of Elections has also faced scrutiny recently, with reports of insufficient safeguards in place. Notably, video footage revealed an employee who declined to prevent a reporter impersonating a non-citizen from registering to vote.
