Patrick Clancy’s detailed description of the tragic night when his three children died may provide prosecutors with a solid foundation to argue that Lindsay Clancy acted with intent and is therefore criminally responsible, according to some legal experts.

During his testimony at Plymouth Superior Court on Wednesday, Patrick recounted the events of January 24, 2023. He explained how he left their Duxbury, Massachusetts home to buy stool softener and picked up dinner afterwards.

While at CVS, he said Lindsay called to confirm his presence and agreed to a generic product as a substitute. However, upon returning home, they found an unsettling silence, blood stains in their locked bedroom, and Lindsay injured beneath an open window on the second floor.

Patrick discovered Lindsay lying on her back, with severe cuts on her wrists and marks on her neck.

When asked what was wrong, she replied, “I was trying to kill myself.” Concerned, he inquired, “Where are the children?”

Lindsay’s response was chilling. “They’re underground,” she said.

Patrick noted that he never claimed the children were in danger or needed help.

Attorney Shari Carney highlighted that seemingly trivial details—like phone calls, text messages, and dinner orders—might play a significant role in the prosecution’s case, which seeks to establish that Lindsay was aware of her actions when her children were asphyxiated with an exercise band.

Carney characterized the case as a dispute between murder and insanity. Patrick’s testimony, she argued, illustrated Lindsay’s lucidity and ability to handle everyday tasks right before the incident.

However, the defense is likely to counter that performing daily activities doesn’t necessarily indicate criminal responsibility. Lindsay’s legal team asserts that she suffers from severe mental health issues, particularly postpartum psychosis, exacerbated by a recent change in her medication.

Patrick shared that Lindsay later remarked she heard a voice urging her to act quickly. He also mentioned that he was unaware of any mental health struggles she had been facing.

The crux of the case may hinge on whether the jurors perceive the actions as premeditated or the result of a significant mental health crisis.

Emotional moments were apparent when prosecutors played Patrick’s 911 call for the jury. Although the court had barred its broadcast, the camera focused on Lindsay as she broke down in tears.

Carney observed that this response could benefit both sides—humanizing Lindsay as a saddened mother while simultaneously highlighting the horror surrounding the children’s deaths.

Before the recording played, Judge William Sullivan reminded jurors to avoid letting emotional responses influence their judgment. He emphasized that their decisions should not be swayed by feelings of sympathy, anger, or prejudice.

Lindsay Clancy, a former labor and delivery nurse, has pleaded not guilty to three counts each of murder and strangulation.
