Police Officer Avoids Charges in Tragic E-Bike Collision that Claimed Cardiff Teens’ Lives

The officer who pursued two teenage boys prior to his fatal e-bike accident in Cardiff has not been charged, according to prosecutors.

The Crown Prosecutor’s Office announced it would not bring criminal charges against South Wales police following the tragic deaths of 15-year-old Harvey Evans and 16-year-old Kyliez Sullivan in Ely, Cardiff on May 22, 2023.

Kyrees and Harvey lost their lives when CCTV footage recorded their crash on a Sur-Ron bike after a police van followed closely behind. The aftermath involved violent confrontations with law enforcement and property damage.

Malcolm Machafee, head of the Special Crimes Division at the Crown Prosecutor’s Office, stated:

“After a comprehensive review of evidence concerning a single dangerous driving allegation in this situation, we have determined that no criminal charges will be brought against South Wales police officers.

“We found that there is insufficient evidence to support a viable conviction. This is disheartening news for both boys’ families, and we acknowledge the need to meet with them to clarify our rationale.”

This decision falls under the Victim Review Right (VRR) scheme, which offers victims or their families an established process to challenge particular CPS decisions against starting or continuing a prosecution.

The tragedy sparked a night of violent unrest during which 15 officers sustained injuries. The crowds claimed they had gathered to honor the deceased youth before engaging in clashes with South Wales police.
