Pornhub Parent Company Settles FTC Lawsuit
Iro, the parent company of Pornhub, along with its affiliates, has come to a settlement regarding a lawsuit filed by the FTC and the State of Utah. The lawsuit alleged that the company misled users about the presence of Child Sexual Abuse Materials (CSAM) and Non-Consensual Materials (NCM) on its platform, with Pornhub opting to resolve the matter by paying a $5 million fine.
This week, the FTC announced the settlement, which addresses accusations that Pornhub claimed to block tens of thousands of videos and photos containing CSAM and NCM, despite the site’s assertions that such content is strictly prohibited.
Under the terms of the settlement, Iro must implement a program aimed at preventing the distribution of CSAM and NCM on its site, and it will pay the aforementioned fine to Utah. In a statement, Iro reiterated its commitment to maintaining high standards of safety and compliance, suggesting that this agreement would bolster the safeguards already in place.
It’s important to note that this settlement does not require Iro to admit to any wrongdoing. Besides paying the fine, the agreement mandates that Iro take several actions, including:
- Creating a system to verify that individuals appearing in videos and photos on their site are consenting adults.
- Removing content uploaded before these new verification measures are in place, ensuring those involved were at least 18 years old at the time of the content’s production.
- Posting notices regarding the FTC and Utah claims on their website.
- Implementing a comprehensive privacy and information security program to address concerns raised in the complaint.
Pornhub began revising its content and moderation practices in 2020 following accusations of child pornography and sex trafficking. The company started requesting proof of consent from all individuals featured on the platform that same year, establishing partnerships with organizations like Missing and Exploited Children (NCMEC).
The complaints from Utah and the FTC predated 2020, primarily highlighting issues with over 100 different sites owned by Iro, along with others affiliated with it. The allegations included references to CSAM found on sites like Keezmovies, Spankwire, and ExtremeTube, featuring content that implied sexual coercion or non-consensual activities.
Pornhub is currently engaged in ongoing disputes with states that are enforcing age verification laws intended to block access for users under 18. For example, Florida recently filed a lawsuit against Pornhub for not adhering to its age verification regulations.
Florida’s Attorney General Usmeyer remarked on the situation, expressing concern that certain pornographic companies are failing to comply with these laws, which puts children at risk of exposure to harmful content.
