Reasons HR executive Kristin Cabot hasn't lost her job amid Coldplay concert cheating scandal

A Human Resources executive from Astronomer reportedly witnessed CEO Andy Byron in a compromising situation with CEO Canoodling at a recent Coldplay concert. This incident led to Byron’s quick resignation following the public uproar.

Chief People Officer Kristin Cabot is currently on vacation, and it seems her future at the New York-based Data Science Company is uncertain. Some legal experts have weighed in, suggesting potential claims of liability or sexual harassment could be exaggerated.

At the Coldplay concert, which took place at Gillette Stadium in Foxborough, Massachusetts, videos surfaced showing Byron dancing with Cabot, gaining attention from attendees and even Coldplay’s frontman Chris Martin.

“In a large organization, firing someone simply because the headlines look bad isn’t commonplace,” attorney Nicole Brenecki commented. “There can be numerous contracts and legal complications involved.”

Brenecki went on to say that if there’s supportive documentation, someone will likely face consequences, though it might take some time.

Cabot, who joined the company in November 2024, found herself at the center of this viral controversy after being called out publicly at the concert. The company has since confirmed that an internal investigation is ongoing.

After the footage of the two executives gained traction online, Cabot was placed on leave, further complicating matters, especially since both appear to be married to other people.

Despite the interim CEO acknowledging the scandal publicly, emails seeking clarification about Cabot’s job were not returned.

This is the latest in CEO controversies.

Co-founder Pete DeJoy remarked on LinkedIn that it’s a strange situation for Astronomer employees, expressing that he never expected anything like this. He also noted that the events have garnered notable media attention within their niche of data and AI.

Another employment attorney, William Caffarro, indicated that while firing Cabot might seem simple, the company could be negotiating an exit contract. He noted, “If you need proof for termination, the personnel director being involved with the CEO is pretty significant.”

Caffarro found it hard to envision how Cabot could remain in her position after all that’s occurred.

Attorney Douglas Wigdor suggested there may be hidden details about the relationships involved, which could explain why Cabot hasn’t publicly departed from the company. He emphasized that the outcome of the internal investigation will heavily influence any decisions about her future.

Wigdor added, “There’s likely more to this story, given how they appeared at the concert. It’s just a brief video, so the full context is unclear.”

Legal experts are also uncertain about Byron having any grounds for a sexual harassment claim given the nuances of power dynamics. “It’s a tough case to make unless there’s some coercive element,” Brenecki explained.

“If they had mutual agreement, claiming harassment would be quite a stretch,” she stated, adding that being embarrassed in front of a crowd is not the same as facing workplace harassment.

Wigdor echoed this perspective but cautioned that his opinion is based on limited information. “She’d need to demonstrate that their relationship was inappropriate, which could be challenging,” he said.
