Eric Swalwell Threatens Legal Action Against FBI

California Democratic Representative Eric Swalwell has indicated he might pursue legal action against the FBI, expressing concern over the potential release of sensitive files as he approaches a competitive gubernatorial campaign in California.

Swalwell’s legal team issued a cease-and-desist letter to FBI Director Kash Patel, claiming that releasing records connected to Swalwell’s past relationship with a suspected Chinese spy, Christine Fang, would breach federal privacy regulations. Their statement emphasized that the move appears aimed at damaging his campaign.

“Releasing these files is clearly an effort to discredit him and disrupt his run for governor,” Swalwell’s attorneys, Sean Hecker and Norm Eisen, argued. They warned that such disclosures could expose Patel and the FBI to significant legal risks.

As of now, there has been no response from the FBI regarding these claims.

The situation intensified following Patel’s report on the matter in The Washington Post. The proposed release of the investigation details ties back to Swalwell’s previous connection to Fang, who allegedly cultivated relationships with Swalwell and others for espionage purposes. Fang was known to have assisted in fundraising for Swalwell’s 2014 House re-election campaign and even placed an intern in his office before he cut ties in 2015 after receiving a warning from the FBI.

No criminal charges were brought against Swalwell at that time, and he has consistently denied any wrongdoing. A subsequent inquiry by the House Ethics Committee concluded in 2023 without any findings of misconduct against him.

Swalwell’s lawyers have also accused Patel of potentially breaching longstanding Justice Department policies regarding investigative actions against political candidates during the two months leading up to elections.

As early voting for California’s gubernatorial primary begins in May, Swalwell is preparing to compete in the general election scheduled for late 2025. “I’m confident there’s still time for Californians to make their voices heard,” Swalwell stated, emphasizing his perceived lead in the race.

Throughout his career, Swalwell has been an outspoken critic of former President Donald Trump, notably serving as a manager during Trump’s second impeachment in 2021 following the January 6 Capitol riots.

Meanwhile, a California Democratic lawmaker is also under scrutiny for possible mortgage fraud, adding another layer to the political atmosphere as the gubernatorial race approaches.

Representative Jamie Raskin from Maryland has criticized Patel’s push to release the so-called “Fang Fang” files, questioning its relevance to law enforcement. “This clearly seems like a politicization of the FBI’s role,” Raskin noted.
