SCOTUS Protecting Institutions, Processes Against Being Disfigured by the Passions of the Moment

After the Supreme Court on Monday granted qualified immunity to current and former presidents, former Attorney General Bill Barr responded to the Supreme Court’s rulings over the past week.

Regarding the presidential immunity ruling, the so-called Chevron doctrine and the obstruction law relating to January 6 protesters, Attorney General Barr said the Supreme Court is protecting its systems and processes from “ephemeral emotions.”

“Well, the idea of ​​going after the Supreme Court [Court] “I think those opinions are spot on,” Barr said. “They were very reasonable opinions. Opinions on immunity, opinions on the Chevron principle, talking about reducing that. Opinions on sabotage statutes, making sure they’re administered properly and that they’re not used as a dragnet.”

He continued, “And I think these were very reasonable opinions that put the law in its right place. And I worry that this anything-goes, let’s-do-whatever-we-can attitude to address the political exigencies of the moment is going to squander what’s important. We’re going to do long-term systemic damage to America. And I think the Supreme Court is doing just the opposite. I think they’re protecting our institutions and our processes from being undermined by the passions of the moment.”
