The US Supreme Court Garland vs Vanderstock Wednesday, I support Biden-era ATF rules for “frames or receivers” kits.
Breitbart News said this incident was Garland vs Vanderstockfocusing on ATF Final Rules 2021-05F. The central part of this rule was to redefine the term “firearm” designating “partially completed pistol frames” and other parts of the gun as “firearms.”
During an oral debate in October 2024, Attorney General Elizabeth Pleger argued that the ATF's incomplete frame classification is maintained because “firearms” are in line with the same position that the government has held for decades.
Pregur I said:
I believe that the context and purpose of the law strongly supports understanding the term in this way. The reason is that throughout the Federal Firearms Act, whenever Congress explicitly provides a definition in itself, includes not only items that are completely complete and functional, but items that can function in that way.
Judge Samuel Alito asked, “Here is a blank pad and a pen. Is this a grocery list?”
Alito asked, “Is it an egg on the counter, chopped ham, some chopped pepper and onions, is it a western omelette?”
Scotus supported the ATF rules by 7-2 votes, with Justices Alito and Clarence Thomas opposed.
The case is Garland vs Vanderstock23-852 in the U.S. Supreme Court.
