Special Counsel Jack Smith files revised indictment against Donald Trump to satisfy Supreme Court ruling on immunity

Special Counsel Jack Smith filed new indictments against former President Donald Trump after the Supreme Court ruled against him some of the charges that the judges had made were covered by presidential immunity.

The revised indictment by a Washington, D.C., grand jury is a simpler version of the previous indictment, containing the same charges of interference with federal elections but including fewer allegations of Trump's conduct.

“The new indictment seeks to address the Supreme Court decision.”

Smith Citation In a 6-3 decision, the Supreme Court on January 1 found that President Trump has “absolute immunity” for acts committed in his official capacity as president or candidate.

“The indictment, presented to a new grand jury that has never previously heard evidence in this case, reflects the government's effort to respect and implement the Supreme Court's decision and remand instructions in Trump v. United States,” the special counsel's office said in a statement.

The new indictment was filed with just 70 days left in the presidential election.

While the new indictment continues to pursue charges against Trump, it also seeks to address Supreme Court rulings. For example, court documents accuse Trump of disrupting the Electoral College certification process on January 6, 2021, and specifically allege that he had no official role in that process.

“Although Defendant had no official responsibility with respect to the certification process, as a candidate he had a personal interest in being named the winner of the election,” the indictment states.

Trump has pleaded not guilty to the charges.

Biden campaign advisers slammed the Supreme Court's July decision.

“After losing the 2020 election, Donald Trump lost his temper and encouraged a mob to overturn the results of a free and fair election,” the statement said. “Trump is running for president as a convicted felon for the same reason he stood by and watched as a mob violently stormed the Capitol — he believes he is above the law and will do whatever it takes to gain and keep power.”

The spokesperson also asserted that President Joe Biden would defeat Trump in November, though the president has since dropped out of the race.
