US foreign policy could be at risk after a federal judge ordered the state to return deportation flights with members of a Venezuelan gang, State Department officials argued in a recent court filing.
“U.S. foreign policy would be harmed if it was hampered by the removal of individuals related to TDA, given the “substantial amount of time and energy” already invested by U.S. government officials,” State Department director Michael Kozak wrote in a declaration filed Monday.
Obama-appointed DC-based Judge James Boasberg issued an order on Saturday to immediately suspend planned deportation of Venezuelans. Boasberg also ordered the Trump administration to notify clients that “the planes that will take off or include these people in the air need to be returned to the US.”

The flight also included suspects of violent gangster Tren de Aragua (TDA).
Kozak said, “It could “change minds” about foreign interlocutors accepting certain individuals associated with TDA, or in other cases they could try to harness this as an ongoing issue.”
“These harms can occur in the short term as well, as future conversations with foreign interlocutors seeking to resolve foreign policy issues should consider this issue along with other issues rather than allowing discussion to proceed fully to other issues,” Kozak writes.
Kozak did not further expand the “harm” that could result from the order in Boasberg's declaration.

“TDA is one of the most violent and ruthless terrorist gangs on the planet,” White House spokesperson Karoline Leavitt told Fox News Digital in a statement. “They are rape, mime, murder for sports. The TDA has been responsible for some of the most heinous crimes that have occurred in the US soil in recent years, including the murders of Laken Riley and Jocelyn Nungaray. The TDA is a direct threat to US national security.”
The Trump administration called the law of 1798 and immediately sought to deport individuals who said it for 14 days.

Boasberg admitted the plaintiff, advances in democracy, and the adjoining ACLU, and granted emergency orders, deportation likely to cause impending “irreparable” harm.
“If you consider the urgent situation, [the court] We are aware of this morning and have decided that an immediate order will be guaranteed to maintain the status quo until a hearing is set up,” Boasberg wrote.

During Monday and the evening hearings, Boasberg asked the Trump administration to submit more information about the flight.
The parties will be ordered to return to court on Friday.

The allegations also argued that the administration's “declaration” and its implementation were “completely legal.”
“Under the power to protect the nation, the President has determined that the TDA represents a significant risk to the United States, that it should entangle and entangle the interests of foreign governments and move forward in a way that opposes the interests of the United States, and that its members should be removed immediately from the country as part of its threat.
