new york the prosecutor said An initial investigation suggests that the man shot another person in the head in self-defense on the subway, and that no charges will likely be filed.
A video of Thursday’s horrifying incident was released on social media, showing the entire altercation between 32-year-old Younes Obouad and 36-year-old Dajuan Robinson.
Robinson apparently accused Obouad of attacking a police officer and then inciting a fight.
“Are you going to beat up the cops?” he reportedly said to the man. “Fuck your race, fuck your race, fuck you.”
While the two struggled, Obuad’s girlfriend stabbed Robinson, who then pulled out a gun when he realized he had been stabbed.
Obuad was able to take the gun from Robinson and fire him four times, hitting him once in the head. The man remains in critical condition at Brooklyn Methodist Hospital.
Obouad was later arrested by police. He was questioned and released on Friday.
On Friday, a spokesperson for the Brooklyn District Attorney’s Office told the New York Post in an email statement that it was unlikely Mr. Obuad would be indicted.
“Yesterday’s shooting on a crowded subway train was shocking and deeply upsetting,” Oren Yaniv said. “While the investigation into this tragic incident is ongoing, at this stage we are unable to file criminal charges against the shooter as there is evidence of self-defense.”
In addition to the gun, Robinson also had a knife, police said.
Officials told The Post that Robinson was shot twice in the right side of his face, with one bullet going through his eye. The other two shots reportedly hit him in the chest and neck. He was also stabbed twice.
Days before the latest violence, Democratic New York Governor Kathy Hochul ordered 750 National Guard troops and an additional 250 law enforcement officers to combat crime on New York City’s subways.
“Such brazen and brutal attacks on our country’s subways are unacceptable,” Hochul said at a news conference. “People heading to work, visiting family, or going to the doctor’s appointment should not have to worry that the person sitting next to them might have a deadly weapon. You don’t have to worry about whether it’s going to turn or not.”
