Supreme Court Allows Trump’s Request to Maintain Dismissals

On Thursday, the U.S. Supreme Court agreed to President Donald Trump’s urgent plea to maintain his decision to dismiss Democrats from both the National Labor Relations Commission (NLRB) and the Merit System Protection Board (MSPB).

In the early weeks of his presidency, Trump removed NLRB member Gwyn Wilcox and MSPB board member Kathy Harris. After taking legal action in April, the Supreme Court, in a 6-3 ruling, put a temporary hold on lower court orders that had sought to prevent the removal of Wilcox and Harris.

“The stay mirrors our belief that the government is likely to demonstrate that both the NLRB and MSPB wield significant enforcement power. However, this perspective doesn’t fully clarify if these entities indeed fall under a perceived exception,” the court explained.

Additionally, the court noted, “This stay signifies our view that the government may experience greater risk of harm from the enforcement activities being continued, instead of from officers being misled due to their failure to meet legal obligations.”

Following their termination, both Wilcox and Harris filed a lawsuit against the Trump administration, arguing that Wilcox still had four years left in her term, while Harris had three. A March ruling from Judge Beryl Howell of the District of Columbia reinstated Wilcox, asserting that Harris could not be removed “freely.”

Subsequently, the Trump administration approached the Supreme Court on April 9, seeking an emergency application after the lower court mandated the reinstatement of both officials. In response, Chief Justice John Roberts granted administrative stays, which would temporarily suspend their reinstatement while the court reviewed the administration’s requests.

This decision is temporary, and the Supreme Court is anticipated to issue a formal ruling following oral arguments next year.
