In opening arguments on March 26, 2024, a majority of the Supreme Court justices appeared to have doubts about a nationwide ban or restriction on mifepristone, the main drug used in medical abortions.

A decision is expected to be made in July.
During the second hour of arguments, Chief Justice John Roberts and Justice Neil Gorsuch asked the challengers’ lawyers about the national impact of the case.
“Rather than looking at the agency in general and saying this relief is not available everywhere, why can’t the court identify exactly which parties this relief applies to?” Roberts said. asked Erin Hawley.
Hawley was going to explain how “unrealistic” these types of remedies are, but Gorsuch stepped in to address the recent surge in universal injunctions. “If you go back and look at it, there were no universal injunctions issued during President Franklin Delano Roosevelt’s 12 years in office, and they were pretty significant,” he said.

“This case appears to be a classic example of turning what could be a small lawsuit into a national legislative session based on FDA regulations and other government actions,” Gorsuch said. said.
The Biden administration argued that even if an action were taken in favor of the plaintiffs, it should not affect the entire nation, not the litigants.
