The attorney representing one of the alleged rapists of Louisiana State University student Madison Brooks said it was important for Brooks to speak with the man she allegedly had consensual sex with in the 24 hours before the attack. .
Joe Long, who represents Kaysen Carver in the ongoing rape case, filed a motion Monday to subpoena and question an unnamed LSU male student and one of Brooks’ female friends.
He said in a court filing that the information could help prove his client’s innocence, according to the report. by WAFB9.
But the latest allegations didn’t sit well with Kelly Miller, an attorney for Brooks’ family, and East Baton Rouge District Attorney Hillar Moore. He told local news outlets that Long’s allegations were “completely unjustified” and vowed to fight them.

Miller told Fox News Digital that Long’s allegations do not comply with Louisiana’s rape shield law and continue the defense’s tendency to “evade the law.”
“We are completely disgusted by this tactic,” he said. “You can’t just turn over a public document like this. There are policies that must be followed to avoid violating the Rape Shield Act, and I think he violated them, but that will be determined by the court.”
Carver, 19, is one of four suspects charged in connection with Brooks’ rape in January 2023. He was charged with two counts of video voyeurism and first- and third-degree rape. He has pleaded not guilty to all charges.

Carver was seen laughing in a cell phone video he recorded and is said to have said, “I think they raped her.”

WAFB reports that because Carver has been charged with an indictment, he does not have a constitutional right to a preliminary examination unless it is necessary to preserve evidence.
Mr. Long argued that it was important to obtain sworn statements from the anonymous male student and Mr. Brooks’ female friend and that they should be allowed in this particular case.
Local reports said the man could not be reached and the woman said she would not testify.

Carver’s video, which has not yet been released, is at the center of the case against him and three other suspects. Kaivon Washington, 18, and Desmond Carter, 17, who are being charged as adults.
Each suspect has pleaded not guilty to all charges.

Mr. Miller was in the courtroom when the video was played. He told FOX News Digital in a previous interview that Carver’s 10- to 15-second selfie video allowed law enforcement to look inside the car.
“You can see what’s going on in the back seat from the right side of the camera,” Miller said. “There you see Kaibon pushing Maddie down.

As the alleged act unfolded, Miller said, music continued to play and at least one of the suspects could be heard cheering.

Good Samaritans try to save Brooks
Prosecutors continued to play a short video clip after an intoxicated Brooks was forced out of the suspect’s car in the middle of Burbank Drive in the early morning hours of Jan. 15.
She stumbled into the middle of a busy four-lane highway and was hit by an oncoming car.

The driver remained at the scene and called 911, but good Samaritans Beau Adams, 21, and Kathryn De Villiers, 21, stopped the car and tried to rescue her.
Paramedics were called and took her to hospital, where she ultimately died.

Prosecutors argued the suspects did not appear to know Brooks had died until the next day, Miller said.
Brooks’ mother, Ashley Baustert, told Fox News Digital that she spoke of Adams and De Villiers’ courage in a previous interview.
“I felt so comforted and at peace that Beau and Kathryn were there. The last few people Maddie saw didn’t mean it.” please be my girlfriend [alleged] attacker” Baustert said.

LSU seniors marked the scene of the accident with a cross in Brooks’ memory along Burbank Highway, where stuffed animals and other trinkets were placed. They also attended Mr. Brooks’ funeral and memorial service.
They have been in contact with Brooks’ mother to check on her.
