The U.S. 5th Circuit Court of Appeals has ruled that Texas can keep the buoys that Gov. Greg Abbott ordered installed on the Rio Grande River. The Biden-Harris administration has sued Texas to stop it from erecting a barrier on the river that separates Mexico from the United States.
“Biden tried to remove them. I fought to keep them in the water,” Abbott wrote on social media. “They’re just going to stay there.”
The 5th Circuit Court of Appeals ruled that Texas can keep these buoys in the water for border security purposes.

Breitbart Texas reported that contractors began installing floating border buoys on the Rio Grande River near Eagle Pass, Texas, about a year ago.
Later that month, the Biden-Harris administration’s Justice Department filed a lawsuit against the Lone Star State seeking to remove the barriers.
Assistant Attorney General Todd Kim and U.S. Attorney for the Western District of Texas Jaime Esparza sent a letter to Governor Abbott alleging that Texas illegally erected a floating border barrier on the Rio Grande River near Eagle Pass. The letter alleges that the buoy-style barrier was erected without approval from the U.S. Army Corps of Engineers. The Department of Justice also alleges that the barrier violates the River and Harbor Act by creating a hazard to river navigation.

continue Grand Bench On appeal, the court’s majority opinion overturned the lower court’s preliminary injunction, writing that “the district court clearly erred in finding that the United States was more likely than not to prove that there was a barrier to navigable sections of the Rio Grande.” The district court’s findings and conclusions are inconsistent with more than a century of precedent.
The full court’s decision also overturned an earlier ruling by three justices that had initially upheld the lower court’s decision.
The case is currently before a lower court in the Western District of Texas, with a trial on the matter scheduled for August 6 in Austin, Texas.
