Texas Governor Greg Abbott is asserting Texas' constitutional right to defend and protect itself in connection with the ongoing border crisis plaguing the state. His analysis came in a statement released Wednesday amid a standoff between state and federal authorities over permission for federal personnel to enter Shelby Park in Eagle Pass, Texas. Governor Abbott ordered state authorities to take over the park in early January. The statement criticizes President Biden for refusing to enforce immigration laws in the state.

President Biden violated his oath to faithfully enforce the immigration laws enacted by Congress. Instead of prosecuting immigrants with the federal crime of illegally entering the country, President Biden sent lawyers to federal court to sue Texas for taking action to secure the border.
President Biden has directed government agencies to ignore federal laws requiring the detention of illegal immigrants. As a result, their collective parole to the United States will be illegally granted.
President Biden will divert illegal immigrants from 28 legal points of entry along Texas' south border by wasting taxpayer money to destroy Texas' border security infrastructure. They separated him and guided him into the dangerous waters of the Rio Grande.
Mr. Abbott also included an analysis of the intentions of the framers of the U.S. Constitution, stating: There is nothing to stop external threats like cartels smuggling millions of illegal immigrants across borders. That's why the Framers included both Article IV, Section 4, which promises that the federal government “shall protect each.” [State] Article 1, Article 10, Section 3 recognizes the “sovereign interest of States in the defense of their national borders.” Arizona vs. United States567 US 387, 419 (2012) (Scalia, J., dissenting opinion).
In the statement, the governor explained his rationale for signing the declaration of invasion under Article I, Section 10, Section 3, invoking Texas' constitutional right to self-defense. “That authority is the supreme law of the land and supersedes any federal law to the contrary,” Abbott said.
The statement followed a 5-4 U.S. Supreme Court order reversing a preliminary order by the U.S. Court of Appeals for the Fifth Circuit that had blocked the Border Patrol from cutting state-installed wire and fences. The court remanded the matter to the lower court due to ongoing litigation.
The statement comes as a standoff between the Biden administration and state officials continues to escalate over Border Patrol access to Shelby Park. This city-owned park is located along his 4.5 miles along the Rio Grande in Eagle Pass. Breitbart Texas reported that on Tuesday, DHS General Counsel Jonathan Meyer sent a second letter to Texas Attorney General Ken Paxton requesting that Texas increase access to border city parks and boat ramps. He asked for full and unhindered access.
The state of Texas has not released a response to the latest request by DHS for park access as of this article.
In response to DHS's initial request, Texas Attorney General Ken Paxton suggested that the conflict over the parks is likely to continue, stating:
Rather than act on Texas' emergency protection request, President Biden authorized DHS to send threatening letters through attorneys. But we also have lawyers in Texas, and I will continue to defend our state's constitutional right to self-defense. Instead of running to the U.S. Department of Justice in hopes of winning an injunction, DHS clients should be advised to do their jobs and follow the law.
