Texas Judge Grants Easter PR Bonds to Rioting El Paso Border Migrants — Blames DA

A Texas magistrate judge ordered an immigrant defendant in the March 21 El Paso border riot to be released on personal recognizance bond on Easter Sunday. The judge accused the El Paso District Attorney’s Office of not being prepared to proceed with detention hearings as required by Texas law.

Presiding Judge Humberto Acosta set public relations bonds for the immigrants accused of participating in the riot on Easter Sunday. according to of el paso times. “It is the judgment of the court that all rioters shall be released on their own recognizance,” Judge Acosta ordered.

Court officials told local news outlets that immigrants in ICE immigration detention will continue to be detained.

Judge Acosta faulted El Paso County District Attorney Bill Hicks’ office for not being prepared for the detention hearing.Texas Criminal Procedure Code need Immigrants arrested without a warrant must be heard by a magistrate within 48 hours of arrest.

Additional magistrate hearings for the arrested immigrants are scheduled for Monday, the newspaper said.

According to court records, the Venezuelans, Omar Alejandro Graterol Colmenares and Jose Guilarte Acosta, were charged with unlawful entry by aliens and were held in federal custody for one day in addition to the time they had already served before being sentenced to prison on charges. He was transferred to state custody.

Graterol is being held on $42,000 bail in El Paso County on state charges of participating in a riot and criminal mischief under $30,000, records show. Mr. Guilarte is being held on $57,000 bail on similar charges.

Seven people were charged with participating in the riot after being indicted on March 28, and the remaining 50 were charged on March 29, according to a review of state court records.

In addition to charges of participating in the riot, some of the immigrants face additional charges, including assaulting the Texas National Guard, destruction of state property, and trespassing.

The KTSM article, citing court records, says one Honduran immigrant, Everisto Benítez Martínez, was charged with assault after he allegedly repeatedly stomped on the knee of a security guard.
