TikTok Settlement Discussions with Justice Department

TikTok is reportedly close to reaching a settlement of around $400 million with the Justice Department regarding child data privacy issues. This is significant since the company was previously willing to pay $1 billion to resolve similar allegations in 2024, according to a report.

In June 2024, the Federal Trade Commission (FTC) under the Biden administration disclosed that it had evidence indicating TikTok had collected data from children under 13 without parental consent, violating the Children’s Online Privacy Protection Act (COPPA).

There have been ongoing calls from policymakers and advocates for stricter regulations on targeted advertising, highlighting concerns that such practices exploit vulnerable children, often leading to increased profits through addictive app features.

As TikTok’s leadership fought against a potential U.S. ban, they were eager to settle the lawsuit. Reports suggest that during discussions in spring 2024, TikTok tentatively agreed to the $1 billion settlement over the allegations, communicated by three individuals familiar with the talks.

Additionally, TikTok is close to accepting other safety measures requested by the FTC, such as prohibiting targeted ads aimed at minors and reducing late-night notifications.

The FTC shared its findings and proposed settlement with the Biden Justice Department, taking the unusual step of making this public, stating it was in the public interest.

However, the negotiations soon broke down.

Officials revealed that top figures in Biden’s Justice Department were wary of finalizing a settlement. They believed that doing so might jeopardize Congress’s ongoing efforts to legislate a ban on TikTok.

A source familiar with the situation remarked, “This is just another instance of the Biden administration struggling to navigate the issues effectively.”

Last week, reports indicated that the Trump administration was nearing a similar $400 million deal with TikTok, with funds earmarked for “beautification” projects in Washington, D.C., rather than for compensating affected children.

This proposal drew sharp criticism from Fairplay for Kids, a prominent online safety advocate, labeling the settlement as insufficient and likely to perpetuate TikTok’s harmful practices. They argued that the $400 million could be merely a fraction of potential fines that could reach into the tens of billions for COPPA violations.

Haley Hinkle, a policy advisor for Fairplay, commented on the lack of significant corrective measures in the reported settlement and expressed concern that, without proper penalties, TikTok’s potentially dangerous design features might continue without real changes.

The White House deferred requests for additional comments to the Department of Justice, which stated, “We are committed to furthering the President’s policies through lawful and fact-based resolutions that protect taxpayer interests.”

TikTok did not reply to requests for comments.

In August 2024, the Justice Department filed a lawsuit against TikTok, notably excluding any mention of ongoing settlement talks. This timing makes it likely that a resolution may not arrive until after that year’s presidential election.

By that time, President Trump had already expressed his intent to “save TikTok” if he were to win. His administration had a crucial role in facilitating a deal that allowed specific U.S. companies to acquire TikTok to bypass any outright bans, with Vice President J.D. Vance playing a significant negotiation role.

Sources indicated that the White House’s closer involvement in these discussions might have reduced the Justice Department’s leverage in the negotiations, leaving TikTok in a precarious position as it sought a more favorable outcome.
