Transgender undocumented immigrant likely to evade prison in NYC rape case

An undocumented transgender immigrant, who pleaded guilty last year to sexually assaulting a teenage boy in a New York City business complex, is likely to receive a plea deal that allows him to evade further prison time.

Nicole Alexandra Contreras-Suarez, a 31-year-old Colombian immigrant assigned male at birth, admitted to second-degree rape after allegations surfaced that he assaulted a 14-year-old boy in East Harlem last year. He was initially charged with first-degree rape and stalking a child under 17.

On Tuesday, a judge from the Manhattan Supreme Court reportedly sentenced Contreras-Suarez to just six months in prison.

It seems that he might get credit for time served, and unless federal immigration officials step in, he could be released upon sentencing on April 27, as reported.

A spokesperson for the prosecutor’s office noted that they expect him to remain in custody for potential deportation following his felony conviction.

The plea agreement was made in coordination with the victim’s family to spare the boy from having to testify in court.

According to prosecutors, the incident occurred on February 11, 2025, when Contreras-Suarez followed the boy into a shopping area near Thomas Jefferson Park and assaulted him. The victim sought help immediately after the attack, leading to Contreras-Suarez’s arrest the next day.

At the time of his arrest, he was dealing with other legal issues in Massachusetts related to charges of prostitution, robbery, and weapon offenses.

After his arrest in New York City, concerns were raised by DHS officials about why he was released prior, citing local sanctuary policies.

Contreras-Suarez had previously crossed into the U.S. illegally and was apprehended by Border Protection in March 2023 in California. After his New York arrest, a DHS official remarked that he should never have been allowed to remain in the country.

Officials with ICE filed an immigration complaint against him, emphasizing their commitment to preventing individuals like Contreras-Suarez from endangering Americans.

Currently, requests for comments from the Manhattan District Attorney’s Office and ICE have not been answered.
