As Breitbart News reported in October 2022, Mexican undocumented immigrant Nicolás Jaimes Hernandez was arrested by 38-year-old Monica Delgado and their two children, 15-year-old Miguel Avila and 14-year-old Miguel Avila. He was charged with capital murder in the shooting death of 2-year-old Monica Delgado. Natalie Aviles, 1 year old, and Lori Aviles, 47, and her daughter Natalie Aviles, 20, who live in Delago's neighborhood.

Late last month, Jaimes Hernandez was deemed incompetent to stand trial on murder charges. As a result, Tetens said KWTX 10 News that this lawsuit could cost Texas taxpayers millions of dollars.
“Experts cost thousands of dollars, defense costs thousands of dollars. Any future appeals will be the responsibility of the state, and that will cost thousands of dollars,” Tetens said. he said. “The entire litigation could definitely run into the millions and could take decades.”
At the time of the murder, Jaimes Hernandez had been living in the United States as an illegal immigrant for nearly 20 years. He was reportedly stopped by local police for a traffic violation before the killing, but was not turned over to Immigration and Customs Enforcement (ICE).
ICE agents issued him a detainer to be turned over to police for arrest and deportation if Jaimes Hernandez is released from police custody at any time.
James Hernandez remains in McLennan County Jail on $4.5 million bail.
