Trump Administration Investigates California for Violating Parents’ Rights on Transgender Issue

The Trump administration is investigating California over a law signed by Gavin Newsom last year, prohibiting the district from adopting policies that require schools to notify parents if their children want to change gender.

Newsom signed the law after several conservative school districts enacted policies requiring schools to notify parents, as reported by Breitbart News last July. The issue arose from concerns that schools encourage students to change gender, and ostensibly concealed the transition from parents due to student privacy rights.

Opinion survey show The majority of Californians agree that their parents have the right to know if they want to change their gender.

Breitbart News faced a newspaper about issues in the spin room of the Republican president's main debate in 2023, and tried to avoid the answer by claiming that the transgender issue is a minor issue.

Today, the US Department of Education's Office of Student Privacy Policy (SPPO) has launched a California Department of Education (CDE) investigation into alleged violations of the Family Education Rights Privacy Act (FERPA). FERPA gives parents the right to access their children's educational data. The California Department of Education is said to have waived the liability placed by FERPA due to a new California law that prohibits school staff from disclosing a child's “gender identity” to parents.

SPPO has reason to believe that many local educational institutions (LEAs) in California may be violating FERPA to socially transition children in schools, while hiding the “gender identity” of minors from their parents. Given the number of LEAs that appear to be involved, the SPPO is concerned that CDE played a direct or indirect role in the widespread adoption of these practices.
