Trump classified documents case dismissed by district judge

A district court judge in Florida has dismissed a document lawsuit against former President Donald Trump, ruling that the “appointment and funding” of special counsel Jack Smith was “unlawful” because it circumvented Congress.

The case concerns allegations that President Trump took classified documents from his time in the White House and stored them in his home. Mar-a-Lago mansion, Federal agents subsequently searched his home, and he also allegedly refused to turn over documents to agents who requested them.

“The Court believes that Special Counsel Smith’s prosecution violates two structural foundations of our constitutional system: Congress’ role in appointing constitutional offices and Congress’ role in authorizing statutory expenditures.”

On Monday, roughly 36 hours after an assassination attempt at a Pennsylvania rally left President Trump injured, Judge Eileen Cannon of the U.S. District Court for the Southern Florida District Court granted President Trump’s motion to dismiss the classified documents lawsuit.

Cannon also spoke about special counsels in general, arguing that executive branches have been appointing them with “increasing comfort” in recent times, and that these prosecutors are rarely subject to “judicial scrutiny.”

according to ABC NewsProsecutors can appeal Judge Cannon’s ruling, and Judge Smith could still file a motion to remove Judge Cannon as presiding judge because, in the outlet’s opinion, the judge “has issued a string of unusually favorable rulings in favor of Trump that have raised the eyebrows of legal experts on all sides of the political spectrum.”

A spokesman for the special counsel did not immediately respond to ABC News’ request for comment.
