Trump Secures Legal Win Over Iowa Pollsters

Recently, President Donald Trump managed to successfully bring a lawsuit against Iowa polling companies J. Ann Selzer and the Des Moines Register, as his attorney, Danny Caron, described, thanks to a “smart strategy” from his defense team.

Trump’s legal representatives have claimed that the pollsters engaged in “brazen election interference” after recent polls indicated he was trailing Democrat Kamala Harris. Initially, the lawsuit’s transfer to federal court was requested in May, following a case move by the defendants. However, a federal judge appointed by Obama denied this, leading to a decision from the 8th Circuit Court of Appeals.

Caron, who has recently published a book titled “Your Love: A Lawyer’s Guide to Legal Health,” believes Trump’s team executed their plan exceptionally well. He noted that the federal judge was not favorable for Trump due to his background, which created a sense of urgency for Trump to return to a state court.

Caron pointed out the importance of finding a judge who might be more inclined to give a favorable ruling, noting, “The idea of ‘forum shopping’ is often about securing the best possible outcome.” He emphasized Trump’s preference for state court judges over federal ones and remarked that now Trump is back to where he feels he needs to be.

This lawsuit, which is not typical as it involves claims of consumer fraud—arguing that the newspaper provided misleading information—has attracted attention. Caron cited Trump’s perspective that the poll “was deceptive and it hurt people” including himself, as it compelled him to allocate campaign resources to address the issue.

Caron anticipates that the Des Moines Register and Selzer might challenge the case with a motion to dismiss. Should that motion be turned down, the process could lead to lengthy and challenging discovery proceedings.

The legal team for Trump welcomed the recent court ruling, asserting it affirms that Trump’s case will unfold in Iowa state court. A spokesperson claimed that the defendants attempted various maneuvers to evade being tried in state court and indicated, “President Trump will continue to hold accountable those who traffic in fake news and lies.”

In contrast, representatives for Selzer and Gannett, the parent company of the Register, expressed that the case is more suited for federal court due to its context involving a former president. They firmly believe the legal matter will find a fair resolution wherever it ultimately lands.

The lawsuit, stemming from December initially in Polk County, seeks accountability for what Trump alleges to be severe election interference involving a manipulated poll released shortly before Election Day. The complaint articulated that the intention behind the poll was to create a false narrative favoring Harris as the likely victor.

Just days before the 2024 election, Selzer released a poll indicating Harris leading Trump by three points—a drastic shift from earlier polling results. This particular poll saw extensive media coverage owing to Selzer’s historically accurate predictions, yet it ultimately proved misleading as Trump won Iowa decisively by more than 13 points.

After the election results, Selzer noted she would be moving on from the polling business to focus on other endeavors.
