In New York City, almost 200 undocumented immigrants face federal charges for unauthorized entry into the United States. This development follows actions taken by the Trump administration to navigate around sanctuary city laws, all in the name of enhancing deportation efforts.
The case shifted from civil immigration issues to federal offenses, allowing ICE agents access to facilities in sanctuary jurisdictions, including New York.
Data shows that over 35,000 illegal border crossings have occurred in the country after individuals re-entered the US multiple times, as reported by the Post.
Federal data indicates that around 200 immigrants have been apprehended in New York City.
According to reports, the Southern District of New York has indicted 26 undocumented immigrants so far.
While living in the US without documentation isn’t seen as a crime under federal law, crossing borders illegally is classified as both a civil and a criminal issue.
Typically, unauthorized entry results in deportation unless the individual has previous deportation orders or has committed other crimes.
Amidst a crackdown on immigration, the Trump administration has tasked ICE agents and DOJ lawyers nationwide with targeting undocumented immigrants for federal criminal charges, as informed by Homeland Security sources.
This administration has also pursued over 4,200 immigrants in California as part of these initiatives.
According to DOJ sources, the Trump administration is encouraging legal teams to adopt more innovative approaches to identify undocumented immigrants who pose “significant risks to public safety” in sanctuary cities.
Federal warrants have provided a means for ICE agents to bypass local sanctuary laws, allowing them access to prisons.
This federal warrant acts as an exception to New York City’s Sanctuary Act, having received approval from a federal Magistrate Judge.
Experts suggest that the Trump administration is proactively challenging the limits of sanctuary jurisdictions. Legal expert Andrew Arthur noted, “They usually respect those warrants, as going against a federal judge could result in serious repercussions.”
“Ignoring a federal judicial warrant is risky,” he added.
Recently, the Trump administration filed a lawsuit against New York City and Mayor Eric Adams regarding Gotham’s Sanctuary Act, following an incident where border protection officers were caught off guard during a robbery involving undocumented immigrants.
A federal attorney stressed, “The United States has a strong tradition of regulating immigration and holds preemptive authority.” They further claimed, “New York City has long obstructed the enforcement of immigration laws, and the consequences of its sanctuary policies are becoming evident.”
Mayor Adams, who has shown interest in modifying the Sanctuary Act, stated that resolving the situation would ultimately be up to the city council.
