UK Regulators Consider Action Against Google

Regulators in the UK are contemplating actions that could increase competition among search engines, particularly concerning the rise of artificial intelligence and its implications for rivals and media outlets.

On Tuesday, officials from the UK’s competitive markets authority indicated that Google might be placed under “strategic market conditions.” This label would enable regulatory bodies to take significant measures. A final determination is anticipated by October 13th.

The agency noted that during their investigation, they became aware of various concerns, such as the unexpectedly high cost of search advertisements in what should be a competitive market. Additionally, they highlighted the “challenges” faced by publishers seeking fair compensation for their content.

Furthermore, the CMA is looking into the potential risks associated with Google’s AI-driven search products.

Potential actions on the table include the introduction of a “selection screen” that would make it easier for users to explore alternative search engines. There could also be restrictions on Google from promoting its own services excessively in search results, giving publishers more say in how their content is presented.

The CMA’s proposed strategic market status would extend to AI-driven search tools, though it won’t include the Gemini AI assistant itself, according to a statement.

Reports have suggested that Google is currently under significant scrutiny both in the US and internationally for its “AI Overview” feature, which places AI-generated summaries at the forefront of search results, often overshadowing links to external sites.

In a new phase of testing, Google is also exploring an “AI Mode” for search, which would create a more interactive experience for users, resembling AI chat interactions rather than standard search queries.

In response to the proposed regulatory changes, Google expressed concern that these could greatly affect businesses and consumers within the UK.

The CMA emphasized that their designation of a “strategic market situation” is not indicative of anti-competitive practices; however, it poses challenges for crucial sectors of the UK economy.

Critics have raised issues regarding the CMA’s broad and somewhat vague approach, suggesting that various interventions are being contemplated without sufficient evidence backing them up.

This regulatory move adds to Google’s difficulties, as the tech giant faces increasing scrutiny in both the US and the European Union regarding its business practices.

A US District Judge is set to determine by August whether to dismantle Google’s search domination based on a ruling from the previous year.

Additionally, Google has experienced setbacks in its antitrust case related to its monopoly over digital advertising technology, with potential remedies to be examined in an upcoming trial.
