Virginia Democrats urge careful consideration regarding a colleague's accusations after supporting prosecutions of Trump.

Democrats in Virginia, who once supported investigations into Donald Trump, are now advocating for restraint following the indictment of one of their own, Virginia Senate President Pro Tempore L. Louise Lucas.

This change is apparent among key party figures. For instance, Lieutenant Governor Ghazala Hashmi, who previously dismissed Republican accusations of Trump’s selective prosecution during his 2023 indictment regarding classified documents, is now emphasizing Lucas’ “constitutional presumption of innocence” and arguing for her right to legal due process. Similarly, Virginia Attorney General Jay Jones, who last year accused Trump of attempting to “incite a riot” and “overturn an election,” insists the charges against Lucas should be evaluated without political bias.

Representative Bobby Scott, alongside Senators Mark Warner and Tim Kaine, also articulated that individuals facing criminal charges are presumed innocent until proven guilty, raising questions about the Justice Department’s motivations. This is quite a shift, especially considering Scott’s earlier remarks during Trump’s first impeachment, where he labeled Trump’s conduct a “gross abuse of presidential power” and asserted that “no one is above the law.” Of course, Trump was acquitted by the Senate.

Meanwhile, Governor Abigail Spanberger is underscoring Lucas’ presumption of innocence, even after previously criticizing Trump’s handling of classified documents as being harmful to national security, shortly before that case was dismissed without trial.

Lucas has been indicted alongside six others, with federal prosecutors accusing them of engaging in a multi-year criminal enterprise related to marijuana distribution, money laundering, bribery, and fraud. She firmly denies any wrongdoing, stressing that an indictment does not equate to guilt. Interestingly, reports suggest that the investigation began during the Biden administration.

The varied messaging isn’t just limited to individual politicians. The Democratic Party of Virginia had declared in March 2023 that Trump was “rightfully indicted” and stated that “no one is above the law” shortly after a grand jury endorsed charges against him—well before a jury actually heard the case. The party had previously rebuffed Republican claims that federal law enforcement was politically manipulated during the inquiry into Trump’s classified documents. It’s worth noting that Lucas serves as a vice chair in the party.

Representative Suhas Subramanyam, the only Democrat who responded to inquiries about the contrasting approaches to Trump and Lucas, insisted that there was no inconsistency in his views. He accused federal authorities of politically orchestrating Lucas’ arrest, stating that regardless of party affiliation, “the American people deserve answers and accountability from everyone.” He acknowledged the seriousness of the charges against Lucas but suggested they were timed for political effect leading up to elections.

Interestingly, the federal investigation that led to Lucas’ indictment actually began before Trump’s second presidency, according to reports from reputable news outlets. U.S. Attorney General Todd Blanche confirmed that the investigation started years earlier and refuted claims of political retribution, asserting, “We don’t do political paybacks.”

The prosecutors’ allegations point to Lucas orchestrating a criminal enterprise with relatives and associates, allegedly facilitating marijuana distribution and laundering its proceeds while leveraging her political role to shield the operation and sway applicable legislation. The indictment claims this group distributed over 100 kilograms of marijuana, with the alleged scheme generating around $4.5 million.

In her defense, Lucas adamantly denies any illegal conduct, asserting that the government is attempting to suppress her voice. Following her surrender to authorities, she remarked, “Today, the FBI, the Department of Justice, and the full weight of the federal government have been wielded against an 82-year-old great-grandmother. I grew up under Jim Crow. I’ve seen what happens when people in power try to silence those who stand up to them.” She added defiantly, “I will not be bullied, and I will not back down.”
