Virginia is the latest in a handful of GOP states that are forcing law enforcement officials to work with federal authorities to deport illegal immigrants.
Republican Gov. Glenn Youngkin issued Executive Order 47 on Tuesday afternoon, declaring “full cooperation” when state law enforcement and correctional agencies concluded a formal agreement with Immigration and Customs Enforcement Agency (ICE) to identify and deport undocumented illegal immigrants. The governor cited federal law under the Immigration and Nationality Act of 1965. This allows state and local law enforcement officials to enter into an agreement that is “represented by the federal government” to carry out certain actions that support federal immigration enforcement.
“Unlawful immigrants of dangerous criminals should not be returned to our community for assault, rape or murder,” Youngkin said in an announcement about the new mission. “They should be sent back where they came.”

Virginia is the latest among a handful of GOP states that force law enforcement to work with ice, but the scope of these new cooperation requirements varies slightly from state to state.
Some states, like Tennessee, are implementing strong cooperation to focus specifically on pursuing undocumented immigration. Others, like Virginia, have directed police to arrest and deport undocumented immigrants living illegally in the state.
Under Youngkin's new order, Virginia State Police will sign a “Memorandum of Understanding the 287(g) Task Force Model” at ICE and create a “State Police Task Force” to help identify and understand “illegal criminal immigrants” that pose risk to the general public.
This agreement gives these federal agents special authority to carry out immigration enforcement functions under the supervision of ICE, where they normally do not otherwise engage.

In addition to requiring compliance from state law enforcement officials, Youngkin's executive order calls on state public safety and homeland security secretary Terrance Cole to require local and local prison authorities to “certify” to provide full cooperation between ICE and the newly represented state task force. The agreement allows Virginia Department of Corrections facilities to be used for immigration issues such as processing and detention.

Cole is also required to contact all directors, sheriffs or other officials responsible for local or local prisons in Virginia to prove that he will fully cooperate with ICE and the newly deputed Virginia State Police Task Force.
