West Virginia Bans 7 Artificial Food Dyes Over Health Concerns

West Virginia prohibits foods containing certain artificial dyes or other additives.

West Virginia Gov. Patrick Morrissey (RW.Va.) signed the law on Monday to House Bill 2354.

The bill was passed Monday morning by lawmakers removing red dye No. 3, red dye No. 40, yellow dye No. 5, blue dye No. 1, blue dye No. 1, blue dye No. 2 and green dye 3 from foods and drugs sold in the state. The bill also bans the preservatives butylated hydroxyanisol and propylparabens.

Additionally, the bill will create prohibited dyes that are not permitted to be offered as part of the school's nutrition program from August 1st.st This year, they said that dyes and two preservatives are not permitted in drugs or foods sold in the state since January 1, 2028.

“West Virginia ranks at the bottom of many public health indicators, which is why American health is not a good place to lead missions again,” Morrissey said in a statement, citing the campaign slogan popularized by Robert F. Kennedy Jr., Secretary of Health and Human Services. “By eliminating harmful chemicals from food, we are taking steps to improve the health of our residents and protect our children from long-term health and learning challenges.”

Foods affected by the ban include Mountain Dew, Doritos, M&MS, several types of Gatorade, finely made lemonade, and many other foods and drinks found in stores.

The latest ban in West Virginia comes after California passed similar laws in recent years to remove additives from foods and synthetic dyes sold from statewide diets.

Additionally, several other states have been introducing since the beginning of this year to ban or regulate certain food additives, including artificial dyes, according to the Environmental Working Group, an advocacy organization focusing on food safety.

Currently, the Federal Drug Administration (FDA) has approved 36 colours of additives for use in US foods and drinks, including nine artificial dyes.
