White House launches national security investigation into pharma, semiconductors

The Trump administration announced on Monday that it had initiated an investigation into the national security implications of importing particular medications, a move perceived as a precursor to implementing tariffs on prescription drugs.

The Commerce Department’s Federal Registration Notice indicated that this investigation, termed the Section 232 investigation, commenced on April 1, the day before President Trump declared extensive tariffs on all imported goods, while excluding drugs specifically.

The Section 232 investigation permits the President to limit imports identified as a national security threat. Last week, Trump stated his intent to introduce “significant tariffs” on prescription drug imports in the upcoming weeks.

The notice specifies that the investigation “covers both completed generic and brand-name drugs, medical products, critical inputs such as active pharmaceutical ingredients, and essential starting materials, alongside the predominant manufacture of these items.”

This investigation focuses on various concerns, including the current and anticipated demand for US drugs, the influence of foreign supply chains—particularly major exporters—on fulfilling US drug demands, risks related to the concentration of imports from few suppliers, and the practicality of enhancing domestic pharmaceutical and ingredient production capabilities.

A standard Section 232 investigation typically spans 270 days before a report is submitted to the President, but public input on the notification is only invited for three weeks after the official release date of April 16th.

Trump initiated a Section 232 investigation regarding the copper and timber industries in March. He has previously leveraged investigations to impose customs duties on imported steel, aluminum, and automobiles.

Additionally, the Department of Commerce mentioned it had commenced a similar investigation into semiconductor technology. Trump asserts that tariffs on electronic chips will compel companies to relocate their manufacturing facilities to the US.
