X Supports Legal Defense of Texas Republican Figure
On Monday, the social media platform X, previously known as Twitter, announced its support for Michelle Evans as she faces legal challenges related to a post made in 2023. Evans, who is the chairman of the Williamson County Republican Party in Texas, faces potential criminal charges for sharing a photo that featured a transgender individual washing their hands in a women’s restroom at the Texas State Capitol.
The photo in question, originally taken by someone else, depicts this incident. Evans shared it as part of a broader commentary on transgender issues, but shortly thereafter, a criminal investigation was initiated by the Travis County District Attorney’s office.
“X stands by Michelle Evans. She is facing potential criminal charges because of her decision to repost a photo regarding a male transgender activist using a restroom at the Texas State Capitol. Notably, Evans did not take the original photo; she merely shared it on X as part of her discussion on this topic,” a statement from X read.
Despite the protections offered by the First Amendment, the 5th Circuit Court of Appeals recently ruled in a 2-1 decision that allowed the investigation to continue. Thus, X is aiding Evans in her efforts to appeal this ruling before all members of the Fifth Circuit.
“We anticipate that the full Fifth Circuit will correct this error and affirm the principles of free speech that are core to democracy in America,” the Global Government Affairs team for X remarked on Monday morning.
Evans shared the controversial photo back in 2023, which prompted a criminal inquiry led by District Attorney Jose Garza after allegations surfaced about photographing individuals in restrooms without consent.
“It’s important to note that Ms. Evans did not take this photo. Her action of reposting it was meant to contribute to the political discourse surrounding transgender issues,” the Office of Global Government Affairs added.
Evans is seeking to have the December 9 decision overturned, which previously permitted the ongoing criminal investigation.
The recent ruling by the 5th Circuit, while splitting votes, has raised concerns about the implications for political expression, to which X has publicly voiced its objections.
“I truly appreciate the support from the X legal team, who are committed to standing up for free speech. Their acknowledgment of how the prosecution’s actions can be seen as a misuse of power is incredibly important to me,” Evans shared.
Numerous Texas politicians and public figures have shown their solidarity with both Evans and X, endorsing the platform’s decision to fund her defense.
