Justice Department challenges New York City's sanctuary policies with new federal lawsuit

The Justice Department has initiated a lawsuit against New York City concerning its sanctuary policies. This move is part of the Trump administration’s broader effort to ramp up deportations and to challenge jurisdictions that resist collaboration with immigration officials.

This lawsuit, filed in federal court in New York, names Mayor Eric Adams and several city officials as defendants. According to the suit, New York City has put policies in place aimed at obstructing the federal government’s ability to enforce immigration laws.

The lawsuit highlights that New York has a long history of being a sanctuary city, going back to 1989, with intensifying measures to oppose federal immigration enforcement over the years.

The Justice Department pointed to city policies that restrict amending practices for honoring requests from U.S. Immigration and Customs Enforcement (ICE), specifically requiring that these federal authorities be informed when illegal immigrants are released from custody.

As noted in the lawsuit, the New York Police Department also adheres to similar stipulations. In 2014, the city further solidified its stance against cooperating with ICE by modifying the sanctuary policy. This includes provisions that require a warrant issued by a judge for detaining immigrant individuals unless they have a serious criminal history or are flagged on federal terrorist watch lists.

The lawsuit indicates that criminal actions committed by undocumented immigrants have led several city leaders to advocate for more cooperation with ICE. Attorney General Pam Bondy stated that the federal government feels compelled to safeguard New Yorkers.

Bondy expressed this sentiment via social media, emphasizing that if local leaders in New York fail to protect their citizens, the federal government will intervene.

Meanwhile, U.S. Representative Nicole Malliotakis hailed the lawsuit, criticizing the sanctuary policy as misguided and detrimental, citing public safety concerns. She stated that ensuring safety in the community requires collaboration with ICE concerning detainee requests; otherwise, dangerous offenders could remain on the streets.

Malliotakis has also indicated that she filed a Freedom of Information Act request revealing that around 16,000 crimes have been linked to individuals residing in hotels and shelters funded by taxpayers.

Fox News Digital has reached out to both Mayor Adams and the White House for comments on this matter. In a related development, the Department of Justice previously filed a lawsuit against Los Angeles over similar sanctuary policies amidst ongoing tensions with the Trump administration regarding deportation efforts and protests against ICE.
