A recent lawsuit claims that a Delta employee behaved inappropriately by taking a child’s iPad left on a plane in New York City.
Tory and Bruke Brewer, the child’s parents, were on their way to London from South Carolina in July 2023 when they realized their child’s iPad was missing. Shortly after, they received strange notifications from their device. Using the “Find My” app, they traced its location to Jamaica, Queens, near JFK Airport.
As the days went on, unsettling photos started appearing in Tory Brewer’s iCloud. One of the images was a selfie featuring a man in a Delta uniform and name badge. Disturbingly, over a month after losing the iPad, the Brewers discovered an explicit video on the device involving a man in the same uniform.
Moreover, the lawsuit alleges that Delta employees accessed the Brewers’ iTunes account, set up their own profile, and even infiltrated their Amazon account. The hacked account was flagged as “gay,” a discovery made by one of the Brewer children, according to the legal filing.
After realizing their device had been misused for inappropriate uploads, the Brewers reported the iPad lost to Delta the day after it went missing. Despite the seriousness of the situation, their only feedback from Delta was an automated email stating they were still searching for the iPad.
In their lawsuit, the Brewers accuse Delta of negligence, emotional distress, harassment, and sexual assault.
They are seeking both damages and accountability from the airline, expressing frustration over Delta’s lack of meaningful response to their plight.
Delta has acknowledged the lawsuit, asserting that the individual involved is employed by a vendor, not Delta itself. An airline representative emphasized their “zero tolerance for illegal behavior” but did not provide additional comments regarding the ongoing legal matter.
